Beta Terms of Service

Beta testers’ data is used to improve King AI. As a beta tester you have no expectation of privacy in the data your King handles through the Service. See section 9 and our Privacy Policy. The paid beta is $36.99 per month, billed monthly in advance through Stripe; cancel anytime in Settings (section 5).

These Beta Terms of Service ("Terms") are an agreement between you and KING HOLDINGS VENTURES LLC, an Illinois limited liability company doing business as King AI ("King AI", "we", "us"). They cover your use of the King AI beta: the King AI website, sign-in and account at usekingai.com, your King (the King AI agent we run for you on a private server we host), the optional companion that pairs your personal computer, and any related apps and documentation (together, the "Service"). By signing in or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What the beta is

King AI is an autonomous AI agent. When you give it an instruction it can plan and carry out steps on its own: run commands and programs, browse the web, read and write files, and, with the tools and accounts you connect, send messages and take actions on your behalf.

The Service is an early beta. It is unfinished, it will change, and it may have bugs, outages, data loss or security issues. Features may be added, changed or removed at any time, and the beta may end. We may limit the number of testers, admit testers by invitation or from a waitlist, and access is personal to you.

2. Eligibility and your account

• You must be at least 18 years old and able to form a binding contract. If you use the Service for an organization, you confirm you are authorized to accept these Terms for it, and "you" includes that organization.
• You sign in with your Google account. During the beta, access may be limited to people we invite or admit. Keep that Google account secure; you are responsible for activity under your King AI account.
• Do not share your access, invite or session with anyone else. Tell us promptly at hello@usekingai.com if you think your account has been used without your permission.

3. Your AI model provider

King AI does not supply the AI model. You bring your own credential, such as a Claude subscription token or an Anthropic API key, from your own account with the model provider (today, Anthropic).

• That account, its usage and all of its charges are yours, and they are separate from the King AI subscription price. Autonomous work can use a lot of model capacity; watch your provider usage and limits. We are not responsible for provider charges, rate limits, or the provider suspending your account.
• Your use of the model is also governed by the provider's own terms and usage policies, which you must follow. Using the Service in a way that breaks them may also break these Terms.
• Your credential is passed to your King and kept with it on its private server, and used from there to call the provider. It is not kept in your usekingai.com account records and it is excluded from the beta data we collect. You can revoke or rotate it with the provider at any time.

4. Your King and its private server

Your King runs on a private server we host and operate for you, one per user. We create it when your subscription starts and delete it when your subscription ends (section 5).

• We rent, run, secure and update that server. Updates are automatic and are applied by us, so you get fixes and security patches.
• Your King has broad access to that server so it can do the work you ask for. Only give King data and access you are willing to let an autonomous agent use.
• Use the server only for your King’s work for you. Do not use it for cryptocurrency mining, to host public services for others, or to attack, scan or overload other systems.
• Your King sends its conversations, instructions, actions and their results, files and content it works with, usage, errors and logs to us automatically, as described in section 9 and our Privacy Policy. It strips passwords, API keys, model and subscription tokens, cookies and saved logins before upload.
• When the server is deleted, everything on it is deleted, apart from a final export of beta data that we keep under section 9. The beta has no backups you can rely on; keep your own copy of anything you need, and download it before your subscription ends.

5. Price, billing and cancellation

• Price. The King AI beta costs US$36.99 per month per user, plus any taxes that apply. Your model provider’s charges are separate (section 3).
• Billing. You pay through our payment processor, Stripe. Your subscription is billed monthly in advance, starting the day you subscribe, and renews automatically each month on the same date until you cancel. By subscribing you authorize us, through Stripe, to charge your payment method each month.
• Cancel anytime. You can cancel at any time in Settings (Manage or cancel under Billing). Cancelling stops the next renewal. Your King keeps running until the end of the month you have already paid for. At the end of that paid month your access stops and we delete your King’s server and the data on it, keeping only the final export of beta data described in section 9.
• No refunds for partial months. Payments are non-refundable, and we do not give refunds or credits for partial months or unused time, except where the law requires it.
• Failed payments. If a payment fails, Stripe retries it over the following days and we may ask you to update your payment method. If the payment still does not go through, your subscription ends, your access stops and we delete your King’s server as above.
• Price changes. We may change the price. We will tell you by email or in the app at least 30 days before a new price applies to you; it applies from your next billing date after that notice. If you do not agree, cancel before then.
• Deleting your account (section 12) also cancels your subscription and deletes your King’s server.

6. Autonomous actions are your responsibility

King acts on your instructions, using the computer, accounts, credentials and tools you give it. Because it acts on its own across many steps, it can make mistakes, misunderstand you, or take an action you did not expect.

• Actions King takes for you are your actions. You are responsible for them and for their results, including messages sent, purchases made, files changed or deleted, and anything done in accounts you connect.
• Only connect accounts and tools you are allowed to use, and only give King the access it needs. Review its settings, permissions and connected tools, and check important work before you rely on it.
• King's output can be wrong, incomplete or out of date. It is not legal, medical, financial, tax or other professional advice.
• When King contacts other people on your behalf, you are responsible for having the right to contact them and for following the laws that apply, including anti-spam, telemarketing, privacy and consumer-protection laws.

7. Pairing your personal computer

You may choose to pair a personal computer (for example a Mac or PC) with your King using our companion app.

• Pairing is optional. Screen viewing and screen control are off by default; King can see or control that screen only after you turn those settings on.
• While they are on, King can see what is on that screen and use the keyboard and mouse as you allow. Close or hide anything you do not want it to see.
• You can turn screen viewing and control off, or unpair the computer, at any time.

8. Acceptable use

You must not use the Service, or direct King, to:

• do anything illegal, or help anyone else do so;
• send spam or unsolicited bulk messages, or make robocalls or texts without the consent the law requires;
• harass, threaten, defraud, impersonate or deceive anyone, or create fake reviews, accounts or engagement;
• access computers, accounts or data you are not authorized to access, break security measures, or create or spread malware;
• infringe anyone's intellectual property, privacy or other rights;
• collect personal data about others unlawfully, or process sensitive data without a lawful basis;
• break the terms of your model provider or of any service King uses for you;
• misuse the server we host for your King as described in section 4;
• interfere with, overload, probe or reverse engineer the Service, or get around invite, usage, payment or security limits;
• harm minors, or produce sexual content involving minors.

We may suspend or end access that we reasonably believe breaks this section.

9. Your content and beta data

You keep ownership of your instructions, files and data, and of the results King produces for you, to the extent the law allows.

The beta exists so testers can help us improve King AI through their information, actions and results. You grant KING HOLDINGS VENTURES LLC a worldwide, royalty-free, perpetual, irrevocable license, sublicensable to the contractors and service providers working for us, to collect, store, copy, review, analyze and use your content, your activity, your instructions, and King’s actions and their results to operate, debug, evaluate and improve King AI, including training, evaluating and tuning prompts and models. This license continues after the beta ends, after your subscription ends, after your King’s server is deleted and after you delete your account.

You acknowledge that, as a beta tester, you have no expectation of privacy in the data your King handles through the Service. What we collect, how it reaches us, who may review it, how long we keep it, and what we do not collect (passwords, API keys, model and subscription tokens, cookies and saved logins) are described in Beta testers: your data is used to improve King AI in our Privacy Policy. Before we delete your King’s server, we keep a final export of that beta data, under this section.

You represent that you have the rights needed to share your content, including any information about other people, with King and with us under this section, and that you will not give King data you are not allowed to share, such as other people’s sensitive data without their permission. We do not sell your data.

10. Feedback

If you send us ideas, suggestions or bug reports, you agree we may use them freely, without any obligation or payment to you. Our rights in your own content are those in section 9.

11. Our software and the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the Service, including your King and the companion app, during the beta and while your subscription is active, under these Terms. We and our licensors keep all rights in the Service, including the King AI name and marks. Some components are open-source software under their own licenses, and those licenses govern those components.

12. Ending your use, termination and deleting your account

• You can stop using the Service at any time. Cancelling your subscription works as described in section 5.
• You can delete your King AI account yourself with Delete my account in Settings, or by emailing hello@usekingai.com. This cancels your subscription, deletes your King’s server and the data on it, and removes your account and sign-in data, your invite, and your computer pairings and device tokens. Beta data already collected, including the final export, may be kept and used under section 9, as described in our Privacy Policy. Deleting your account does not refund the current month (section 5).
• Data on your own personal computer stays under your control. Uninstall the companion app from any paired computer, and revoke your model credential with your provider if you no longer want it used.
• We may suspend or end your access, or revoke an invite, at any time, including if you break these Terms, if your payment fails, if needed to protect you, others or the Service, or if we end the beta. Where reasonable we will tell you first. When your access ends, your subscription ends and your King’s server is deleted as described in section 5.
• Sections 5 (as to amounts owed and refunds), 6, 9, 10 and 13 through 18 continue after your access ends.

13. No warranty

THE SERVICE IS A BETA PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS. TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR KING'S OUTPUT OR ACTIONS WILL BE ACCURATE, SAFE, SECURE, UNINTERRUPTED OR ERROR-FREE, OR THAT DATA ON YOUR KING’S SERVER WILL BE PRESERVED. WE ARE NOT RESPONSIBLE FOR THIRD-PARTY SERVICES, INCLUDING YOUR MODEL PROVIDER, GOOGLE, STRIPE, OR ANY ACCOUNT OR TOOL YOU CONNECT.

14. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, KING HOLDINGS VENTURES LLC AND ITS MEMBERS, MANAGERS, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR MODEL PROVIDER CHARGES, ARISING OUT OF OR RELATED TO THE SERVICE OR ANY ACTION KING TAKES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND FIFTY US DOLLARS (US$50). Some places do not allow some of these limits, so they apply to you only as far as the law allows.

15. Indemnity

To the extent the law allows, you will defend and hold harmless KING HOLDINGS VENTURES LLC and its members, managers and contractors from claims, losses and costs (including reasonable attorneys' fees) brought by third parties that arise from your use of the Service, the actions King takes on your instructions, your content, or your breach of these Terms or of law.

16. Changes to these Terms

We may update these Terms as the beta changes. We will post the new version here with a new "Last updated" date and version and, for material changes, tell you by email or in the app before they take effect. Price changes follow section 5. If you keep using the Service after a change takes effect, you accept the updated Terms; if you do not agree, cancel your subscription and stop using the Service.

17. Governing law

These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Illinois, and you and we consent to their jurisdiction, except that either party may seek urgent relief in any competent court.

18. General

These Terms and the Privacy Policy are the whole agreement between you and us about the beta. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, we do not waive it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, employment or agency relationship.
